Our Constitution
- Name
- The Governing Body shall be called the Jersey Petanque Association (JPA).
- Aims and Objectives
- To be the governing body for Petanque in Jersey.
- The objectives of the JPA shall be to make Petanque available and accessible to everyone in Jersey
- To increase the participation in Petanque for all age groups and abilities.
- To organise and administer JPA competitions.
- To select Island Representative teams.
- To follow and adhere to the playing rules of the Federation Internationale de Petanque et Jeu Provencal.
- To affiliate to the British Petanque Federation or directly to the world body.
- To adopt the doping policy of the International Petanque Board.
- To create a long term development plan for Petanque in Jersey.
- Membership
- The JPA shall consist of the Officers and the members.
- Membership of the Association shall be open, and not unreasonably restricted on the grounds of sex, race or of political, religious or other opinions, to any person who is prepared to accept and support the objectives of the JPA.
- In accepting membership, a person agrees to abide by the constitution of the JPA and the rulings of the JPA Committee.
- Members under the age of 16 shall be considered as junior members. Junior members shall not have the right to vote at Annual General Meetings (AGM).
- Each registered player shall be deemed a member of the JPA.
- The Secretaries of Affiliated Clubs must supply the names of their members to the General Secretary, at least 28 days before the A.G.M.
- Membership Fees
- Membership fees for Registration shall be decided at the A.G.M.
- Officers
- The officers of the JPA shall be:
General Committee
Chairman
Vice Chairman
Secretary
Treasurer
Competitions Officer
- These Officers shall be elected for one calendar year, but shall be eligible for re-election.
- The General Committee will consist of the Officers plus one representative, elected or selected, by the affiliated Clubs, who may also nominate a substitute who will attend in the representative’s absence.
- Any vacancy may be filled by the Committee’s decision.
- General Committee
- The management of the JPA shall be vested in the Committee.
- The Secretary shall convene meetings of the Committee.
- The quorum necessary for the transaction of business at General Committee meetings shall be 5 present and eligible to vote.
- Every question at a meeting of the General Committee shall be determined by a majority of the vote of the members present and voting, every member having one vote. In the event of an equality of votes, the Chairman shall have the casting vote to retain the status quo.
- The interpretation of the JPA constitution shall be vested in the General Committee, who shall decide all questions relating to the JPA, save those specified in or involving an amendment to the Constitution.
- The General Committee may employ professional officers at its discretion.
- At the formation of a new General Committee each officer must be made familiar with and sign the current Constitution.
- In the event of any question or matter arising, which is not provided for in the constitution, the General Committee, whose decision shall be final, shall deal with such question or matter.
- The General Committee may set up sub-committees to deal with specific matters.
- Finance
- All monies raised by, or on behalf of, the JPA shall be applied to further the objects of the JPA and for no other purpose.
- The JPA Treasurer is responsible for the finances of the JPA.
- The Financial year of the JPA ends on 28th February each year.
- Proper accounts shall be kept of all sums of money received and paid out by the JPA.
- A statement of accounts, up to and including this date, shall be presented at the Annual General Meeting of the JPA.
- The funds of the JPA shall be lodged at a bank or building society in the name of Jersey Petanque Association and all cheques, drafts etc, drawn on these accounts shall be signed by any two of the following officers; Chairman, Secretary and Treasurer.
- Honorary Auditors shall be elected at the A.G.M.
- Annual General Meeting and Other Meetings
- The Annual General Meeting (AGM) of the JPA shall be held every year during the month of April, when the annual report of the General Committee and the statement of accounts up to the end of the financial year shall be presented and officers elected.
- The date of the following year’s AGM will be decided at each AGM and the committee will remind members of the date in a newsletter at least 8 weeks before the meeting.
- The Secretary shall receive nominations for Officers not less than 6 weeks prior to the AGM. Nominations shall require two signatures. Nominations can only be accepted from persons eligible to vote at the AGM. In the case of “No Nominations” the Chairman may accept nominations from the floor at his/her discretion.
- The dates of the General Committee meetings shall be determined at the previous meeting. In addition, the Chair may call a meeting when he/she considers it necessary or desirable, or upon the written request of at least two members of the General Committee.
- All members shall be entitled to vote at Annual General meetings of the Association and shall have equal voting rights.
- The quorum for Annual General meetings shall be a minimum of 10% of the membership.
- An Extraordinary General Meeting (EGM) shall be called by an application in writing to the Secretary signed by not less than 15% of members. The General Committee shall have the power to call an EGM by decision of a simple majority of its members.
- Motions to the A.G.M. must be notified to the Secretary at least 6 weeks before the meeting. All motions for inclusion must have a proposer and seconder.
- The Secretary shall send the minutes of the previous AGM, the Agenda for the coming AGM and advice of the nominations for officers received to all members at least 4 weeks before the AGM or EGM
- Voting Procedure
- A motion shall be carried by a simple majority of those present and voting, except when the motion is a constitutional amendment, which shall require a two-thirds majority of those present
- The Chair shall have a casting vote to retain the status quo in addition to a deliberative vote.
- Property and Staff
- Responsibility for all property owned or leased by the JPA and for the employment of paid staff and volunteers rests with the General Committee.
- Discipline and Appeals
- The General Committee shall have the power to take appropriate disciplinary action against any member and shall have the authority to terminate the membership of any member guilty of conduct deemed to be to the detriment of the JPA.
- There shall be the right of appeal to the General Committee, or an Appeal Committee set up by it to act on its behalf, against any decision made by an officer of the JPA.
- The appeal should normally be considered within 14 days of it being received by the Secretary.
- Dissolution Procedures
- In the event of the passing of the resolution to wind up the JPA, the members of the JPA shall appoint a representative committee.
- In the event of the JPA ceasing to exist and following the discharge of all debts and liabilities, the representative committee in accordance with 12.3 below shall dispose of any assets at the time of dissolution.
- The representative committee shall be empowered to distribute the assets, including cash and investments in hand, to clubs or organisations having similar objectives as their own.
